Young people have the right to make decisions about an Education, Health and Care Plan (EHCP) from the end of compulsory school age (16).

The Children and Families Act 2014 identified a number of decisions in relation to Education, Health and Care plans (EHC plans).

The specific decision-making rights which apply to young people directly from the end of compulsory school age (16), are: 

  • the right to request an assessment for an EHC plan (which they can do at any time up to their 25th birthday) 
  • the right to make representations about the content of their EHC plan 
  • the right to request that a particular institution is named in their EHC plan 
  • the right to request a Personal Budget for elements of an EHC plan 
  • the right to appeal to the First-tier Tribunal (SEN and Disability) about decisions concerning their EHC plan.

Before end of compulsory school age (16), parents/ carers would help you to make decisions about your care plan with professionals. 

Your EHCP is tailor made to your needs which means that you can keep a record of all the help and support you have with important dates in it. However, if you decide you no longer need your plan you can talk to the SENSTART Team and tell them how you feel. 

Decision not to maintain the EHCP will be based on the Annual Reviews that take place to determine whether remaining in education and training provides evidence of impact and progression. Each Young Person's exit from an EHCP will be planned carefully to support transitions and effective preparation to adulthood.
